SAMPLE GUARDIAN CONTRACT - FEMALE
Guardian Homes Agreement- XXXXXXXXXXXXXXXXX
1. Purpose of Agreement: The purpose of this agreement is to define the terms and
conditions of a guardianship agreement between XXXXXX hereafter referred to as
“guardians”, and xxxxxxxx, representing xxxxxxxxxxx, hereafter referred to as “breeder”.
2. Agreement Participants: This agreement pertains to a female XXXdoodle, out of (dams
name), by (sires name), microchip (XXXX), born on (XX/XX/XX), and is entered into on
X/XX/XX.It is between the guardians and the breeder.
3. Definition of terms:
A. Well veterinary visits: A veterinary visit, scheduled in advance, the purpose of which is
preventive care, vaccinations or determination of normal growth and health.
B. Sick veterinary visits: A veterinary visit, scheduled for the purpose of investigating or
treating an ill or injured dog.
C. Potential breeder: A female dog that has not yet whelped a litter.
D. Proven breeder: A female dog that has successfully whelped a litter.
4. The above named dog will continue to be owned by XXXXXXXXXXXXXXXXX until the dog
has whelped five litters, or for five years from the date of the contract, whichever comes
later, or until the agreement is terminated by one of the parties in a way defined by this
agreement. The dog will live with and be cared for by the guardian in a manner defined by
the terms of this agreement during that time. All decisions related to the breeding and
reproductive life of the dog rest solely with the breeder.
5. Breeder Obligations:
A. The breeders will provide written instruction to the guardians regarding nutrition, training
and veterinary care.
B. Breeders will visit the guardian home a minimum of 1 time per year.
C. Breeders will approve the choice of the dog’s veterinarian and pay for well-veterinarian
visits and standard preventive veterinary care.
D. Breeders will request transportation of the dog in cases where that is necessary. At
least 3 days advance notice will be given to the guardians when transportation is
necessary.
E. If less than 3 days notice is necessary, all responsibility for transportation rests with the
breeders.
F. Breeder will pay guardian $150 each time the dog whelps a litter.
Failure to meet these obligations can result in the guardian terminating the guardianship
agreement, resulting in the return of the dog to the breeders.
6. Guardian Obligations:
A. The guardians are responsible for properly maintaining, containing, training and
caring for the dog using methods approved by the breeders.
B. Guardians must follow breeder’s nutritional guidelines, exercise the dog appropriately,
pay for care and food-related expenses, and pay for sick visits to the veterinarian.
C. Guardians must surrender the dog to the breeders whenever requested and on
occasions such as, but not limited to, breeding, dog romps, veterinary visits and
whelping. The dog will reside with the breeders until the whelped litter is weaned.
D. Guardians must inform breeders of vacations and planned absences. Any persons
caring for the dog in the guardian’s absence must be approved by the breeders in
advance.
E. Guardians agree to cooperate in arranging transport of the dog to assigned location
upon breeder’s request for testing, insemination, or for natural breeding, or other
occasions, following instructions of XXXXXXXXXXXXXXXXX.
F. Guardians will inform the breeder as soon as there is evidence the dog has come into
season.
F. Guardians may not choose or allow any elective veterinary procedures to be performed
on the dog without the written consent of the breeders.
G. Guardians may not use or allow the use of the dog for breeding purposes except as
those arranged for by the breeders.
H. The guardians are responsible to insure that all persons residing with the guardians
and the dog understand and abide by the guardian contract.
I. Guardians agree to reside within 250 miles of XXXXXXXXXXXXX for the duration of this
contract. If guardian residence changes to a location outside this radius, the dog will be
returned to the breeder.
Failure to meet any of these obligations can result in the dog being removed from the
guardian home and termination of the guardianship agreement
7. Illness, Injury or Death of the dog while in the guardians care:
A. The guardians are responsible for seeking prompt and appropriate veterinary care in
the event of injury or illness of the dog.
B. If choices need to be made regarding type of treatment these choices must be
presented to and made by the breeders unless emergency treatment is required.
C. If the dog dies accidentally due circumstances beyond the control of the guardians the
guardians do not owe any payment to the breeders.
D. If the dog dies due to negligence on the part of the guardians the guardians owe the
breeders $2500. Negligence is defined as:
i. Failure to contain or supervise the dog in a responsible manner.
ii. Leaving the dog alone in a vehicle if the outdoor temperature is over 65 degrees
iii. Failure to prevent the dog from having access to toxic materials.
iv. Failure to provide safe means of containment while the dog is in a moving vehicle (use
of a crate or canine safety belt is recommended).
v. Leaving the dog in the sole care of a person under the age of 14 years.
8. Death of the Dog while in the breeders care:
If the dog dies while in the breeders care, the breeder will provide, free of charge, a
replacement puppy to the guardian and the guardianship relationship is terminated.
9. Transfer of ownership of a proven breeder:
After four years has passed from the date of the contract, or after the dog has whelped five
litters, whichever occurs first, or if determined by the breeders that conditions warrant it,
the dog will be spayed at the breeder’s expense. At that time the guardians will have the
option of returning the dog to the breeder, or purchasing the dog for $500. If they chose to
purchase the dog, legal ownership of the dog will be transferred from the breeders to the
guardians at this time.
10. Transfer of ownership of a potential breeder:
If at any time it is determined by the breeders that conditions warrant it, the dog will be
spayed at the breeder’s expense. At that time the guardians will have the option of
returning the dog to the breeder, or purchasing the dog for $500. If they chose to purchase
the dog, legal ownership of the dog will be transferred from the breeders to the guardians
at this time.
The guardians may return the dog to the breeders at any time and for any reason and the
guardianship agreement will be terminated.

agreement, resulting in the return of the dog to the breeder.

G. Guardian may not use or allow the use of the dog for breeding purposes except as
those arranged for by the breeder.
H. The guardian is responsible to insure that all persons residing with the guardian
and the dog understand and abide by the guardian contract.
I. Guardian must live within 120 miles of XXXXXXXXXX for the duration of the contract.
Failure to meet any of these obligations can result in the dog being removed from the
guardian home and termination of the guardianship agreement. If the guardian
relationship is terminated due to failed obligations on the part of the guardian, the
guardian shall pay the breeder $5000 in addition to surrendering the dog.
7. Illness, Injury or Death of the dog while in the guardians care:

8. Death of the Dog while in the breeders care:
If the dog dies while in the breeder’s care, the breeder will provide, free of charge, a
replacement puppy to the guardian and the guardianship relationship is terminated.
9. Transfer of ownership of a proven breeder or proven sire:
At the age of 5 years, or at an earlier age if determined by breeder that conditions warrant
it, the dog will be desexed at the breeder’s expense. Legal ownership of the dog will be
transferred from the breeder to the guardian at this time.
10. Transfer of ownership of a potential sire:
A. If it is determined by the breeder that it is in the best interests of the breeders or the
dog, a potential sire can be desexed at the breeder’s expense. The guardians will have
the option of purchasing the dog for $500. If this option is chosen, legal guardianship of
the dog will transfer to the guardian.
B. If the Guardian chooses not to purchase the dog, breeder will take possession of
the dog and the guardian relationship will be terminated.
11. Return of the dog:
The guardian may return the dog to the breeder at any time and for any reason and the
guardianship agreement will be terminated.
